Our intention is to make your stay as comfortable as possible and for you to enjoy the city of Malaga. The following terms and conditions demonstrate LIVING4MALAGA’s commitment to our customers once you rent one of our accommodations.

Please read all the points of this contract carefully.

Users are responsible for ensuring the validity of the terms and conditions included on this page. The mere use of the services of this page implies agreement and acceptance of these terms and conditions, as well as any future changes made prior to your stay in the apartment. We recommend reading the conditions under which you make your reservation. Acceptance of these conditions is essential to be able to book and access the apartment.

BOOKING PROCESS

Our automatic system for availability and pricing calculation will allow you to choose the apartment you are interested in and immediately make an online reservation for it.

Initial payment: To book the chosen apartment, select it and include the requested information. If you ultimately wish to reserve the apartment, an initial online payment will be made with a credit card, representing 30% of the total amount. In case the provided credit card is not valid, and the charge cannot be processed by living4malaga.com, a member of our team will contact you using the phone number or email address you provided. If the change of the card number is not carried out or it is not possible to contact you through the provided contact information, the reservation will be canceled automatically. In that case, you will receive an email confirming the cancellation.

Reservation confirmation: Once the initial payment has been made, the reservation will be confirmed instantly, and you will receive a welcome email with all the details of your reservation (reservation data, apartment address, contact person’s information, etc.).

Final payment: The remaining 70% of the amount will be charged 4 days before your arrival at the selected apartment through a payment link you will received by email. Also, you can pay for the accommodation in your Guest Area.

PRICES

Prices are always displayed in EUROS (€) and may vary depending on the time of year or special events, depending on each of the apartments. Therefore, LIVING4MALAGA.com reserves the right to change them, updating them automatically on the website.

MINIMUM STAY

The minimum stay may vary depending on the accommodation and/or season.

Living4malaga reserves the right to establish the minimum stay for accommodations based on occupancy and demand.

ARRIVALS AND DEPARTURES

Normal check-in time for the apartments: from 16:00 PM (in some properties this schedule may vary). If you arrive after 19:00 you need to contact us to organise your arrival.

Normal check-out time for the apartments: Before 12:00 p.m. (in some properties this schedule may vary)

The customer must always inform us of the approximate arrival time and do the online check-in before the arrival.

At the time of arrival, the ID card or passport of the person who made the reservation and their companions over 16 years of age must be presented.

Departures after 12:00 PM without express permission from LIVING4MALAGA.com will incur an additional charge.

SECURITY DEPOSIT

LIVING4MALAGA.com reserves the right to require a security deposit in the amount of 150€ – 1500€ (this amount may vary depending on each accommodation, we advise you to previously check the conditions in the detailed description of each apartment).
 
Living4malaga requests a deposit, the amounts of which are indicated in the description of each accommodation. To facilitate the management of the deposits, we use the Swikly service, a secure solution, which allows to deposit deposits online simply using a bank card number, without impacting the guest’s bank statement. To deposit the deposits, simply click on the Swikly link sent by Living4malaga and follow the requested steps. This is not a payment: the Guest will not be charged the requested amount, but authorizes such charge in case of damage or cleaning not carried out.
 
Collection of the damage deposit: as soon as the property is returned and no damage has been observed during the inventory of the facilities at the end of the stay, the bank details will be withdrawn at the latest 20 days after the end of the stay.
Otherwise, the damage deposit will be charged by Swikly, when Living4malaga has deducted the amount of the damage. If the amount is not enough to cover the damages, the Owner will ask the Client to reimburse the excess.
 
At living4malaga.com we work from empathy and common sense. We ask our guests to leave the apartment tidy, remove the garbage, dishes and clean dishes, and leave the set of keys where they have been informed during check-in.

CHANGES OR MODIFICATIONS BY THE CLIENT

In case the customer decides to change or modify the dates of arrival/departure or the number of people staying in a confirmed reservation, LIVING4MALAGA.com commits to finding a satisfactory solution whenever possible. However, the total price will not be modified if you want to reduce the number of days and/or the number of people from the previously reserved stay. In the event of requesting a change of ACCOMMODATION, the customer must cancel the previously confirmed reservation, adhering to the cancellation conditions, and then make a new reservation.

CANCELLATIONS

Please note that if you wish to cancel or modify your reservation, you need to contact us. Check your cancellation policy during your booking process. Refunds, if applicable, will be processed via bank transfer within a maximum of 7 business days.

LIVING4MALAGA.com will only accept cancellations or modifications of your reservation in writing via email.

Failure to show up on the agreed date without prior notice will result in a charge for the entire stay.

All cancellations are subject to these cancellation conditions.

Cancellations due to force majeure must be substantiated through official channels and can be made up to 48 hours before your arrival.

CANCELLATIONS AND MODIFICATIONS BY LIVING4MALAGA.COM

If an accommodation cannot be occupied due to a double booking (overbooking) or due to unforeseen and non-attributable circumstances to LIVING4MALAGA.com, we will contact the customer as soon as possible and try to provide an alternative, offering another accommodation of equal or superior characteristics. If this option is not possible or you do not accept the change or modification, the reservation will be canceled, and you will be immediately reimbursed for the entire amount paid. No subsequent claims or complaints will be admissible in these cases.

COMPLAINTS OR GRIEVANCES

Any complaint or grievance must be reported immediately to LIVING4MALAGA.com in order to resolve the issue. If the complaint can be clearly attributed to LIVING4MALAGA.com, we commit to finding satisfactory solutions for the customers.

LIVING4MALAGA.com will not be responsible in any case for events beyond the company’s control or resulting from force majeure or unforeseen circumstances, such as noise from nearby accommodations, noise caused by construction near the reserved property, general supply cuts unrelated to the property, elevator malfunction in the building, etc. Complaints or claims will not be accepted once the check-out has been completed, and therefore, any right to compensation or resolution will be forfeited.

EQUIPMENT/SUPPLIES/CLEANING

The normal costs of electricity, gas, and water incurred during your stay are included in the rental price. Accommodations are cleaned before each guest’s arrival and will be provided with a set of sheets and towels per person. We perform a change of the sheet and towel set if your stay is 8 days or longer. On the day of departure, you should leave the property in acceptable conditions of order and cleanliness (dispose of trash in the outdoor containers and clean the dishes and utensils in the kitchen). LIVING4MALAGA.com reserves the right to claim or not refund the security deposit if the apartment is not found in such conditions. Costs incurred by leaving the keys in the lock on the inside of the accommodation will always be the responsibility of the tenant.

RESPONSIBILITY

You agree to abide by the house rules and, above all, the quiet hours. It is not permitted to use the apartments for party celebrations (whether spontaneous parties, bachelor/bachelorette parties, etc.). Under no circumstances are you allowed to occupy the apartment with more people than its maximum capacity (except babies under 2 years old). You also commit to following the usage and maintenance instructions provided by the company and to comply with regulations regarding noise, garbage disposal, normal electricity and water consumption, etc. In the event of any breach of the aforementioned obligations, living4malaga.com has the right to request that you vacate the apartment, and you will not be entitled to any form of financial compensation. Neither LIVING4MALAGA.com nor the property owner will be responsible for any direct or indirect damage that may result from the use of the apartment, including, without limitation, damage, losses from fires, theft, or criminal activities.

By booking with LIVING4MALAGA.com, you agree not to engage in dangerous, offensive, noisy, illegal, or immoral activities on the property, as well as any acts that could create discomfort among the neighbors. You will be responsible for covering the expenses resulting from any damages caused by you or a member of your group.

SECURITY AND PERSONAL RESPONSIBILITY

Lost items will be kept for a period of 2 months. It is your responsibility to ensure that necessary precautions against theft are taken: locking the door and closing all windows when you are not at home, etc. In the unlikely event of theft or damage to personal property, fire, terrorist attacks, civil disturbances, or other force majeure circumstances, neither the rental agency nor the apartment owner is liable for direct or indirect damages suffered.

All descriptions and information apply to the published apartments. While LIVING4MALAGA.com makes every effort to maintain accuracy and verify details whenever possible, LIVING4MALAGA.com is not responsible for any errors or omissions that may arise. LIVING4MALAGA.com also reserves the right to change information published on the website, such as prices, descriptions, and photos, at any time. LIVING4MALAGA.com reserves the right to update any of its terms of use at any time as required by its business.

DISPUTE RESOLUTION

For any legal issues or matters concerning our website or any of its dependencies, Spanish law shall apply. Competent courts for resolving all disputes arising from or related to the use of this website are the Courts and Tribunals of Málaga, Spain, and, if applicable, Consumer Arbitration Tribunals or similar bodies to which we may adhere at the time of the dispute. To file complaints regarding the use of our services, you can contact us via the email address provided above, and you must, in all cases, seek an amicable solution in the first instance.
